The Cornish national minority and the Framework Convention for the Protection of National Minorities - Part III.
With reference to my previous communication of 5th February 2007 detailing background points in support of an allegation of the violation of the European Convention of Human Rights (ECHR) Article 7 by the government of the United Kingdom being Part I, dated 18th January and Part II dated 5th February 2007.
Submitted herewith is an outline of the legal argument in respect of proposed reasons for the decision of the government of the United Kingdom to exclude the Cornish from the provisions of the Framework Convention for the Protection of National Minorities in its Second Report to the Council of Europe.

The Cornish national minority and the Framework Convention for the Protection of National Minorities
I submitted an objection on 19th January 2007 against the decision by the Department for Communities and Local Government to exclude the Cornish from the provisions of the Framework Convention for the Protection of National Minorities in its Draft Second Report to the Council of Europe. A copy of the Draft was received by me on 9th December 2006 with an accompanying letter stating that responses were to be submitted by 20th January 2007.
With the intervening Christmas and New Year holidays it was not possible to do more than submit to the Department for Communities and Local Government (DCLG) an outline of a case to answer under Article 7 of the European Convention of Human rights. (ECHR).
I am therefore now submitting to the Council of Europe further substantiating evidence, copy to DCLG. Here, the document of 19th January 2007 is referenced as

I write following recent efforts on our behalf to secure through the High Court an interim prohibitory injunction preventing the Secretary of State from submitting the UK 2nd Report on the Framework Convention for the Protection of National Minorities to the Council of Europe without first subjecting that document to judicial scrutiny. The hearing took place on Friday 26th January 2007 before Mr Justice Mitting in Court 3 at 10.30am.
